Can banks run referral programs?
Yes. Large US banks run public refer-a-friend programs for deposit accounts today. Are bank refer-a-friend programs legal for deposit accounts?
Yes, and the biggest banks prove it in public. Chase's published refer-a-friend page pays a fixed cash reward when a referred friend opens a qualifying checking account ($50 per friend, capped at $500 a calendar year, at the time of checking). Fixed rewards, published terms and annual caps are the pattern to copy.
What does RESPA mean for mortgage referral programs?
RESPA Section 8, implemented in Regulation X, prohibits giving or accepting any fee or thing of value for referring settlement-service business on federally related mortgage loans. A checking-account referral program is fine; the same program must not pay anyone for steering mortgage business. The penalties are covered on the finder's-fee page.
The regulation carries its own narrow exceptions, including payments by an employer to its own employees, but the safe design rule for a marketing team is simpler: keep mortgage and settlement products out of the reward logic entirely unless counsel has approved the structure.
Can banks pay employees or customers for securities referrals?
Only inside tight lanes. FINRA Rule 2040 bars paying transaction-based compensation to people who should be registered. Regulation R's networking exception lets unregistered bank employees receive a nominal, fixed-dollar, one-time referral fee, and only when payment does not depend on whether the referral results in a transaction.
What about investment advisers paying for client referrals?
The SEC Marketing Rule (206(4)-1, in force since 2021) replaced the old cash solicitation rule. Compensated referrals and endorsements are permitted with clear disclosure of the compensation and conflicts, adviser oversight, and a written agreement once compensation passes the de minimis threshold of $1,000 over twelve months.
Is there a UK ban on referral incentives?
Not a general one. The FCA banned refer-a-friend bonuses specifically for cryptoasset promotions from October 2023, and its guidance on staff incentives (FG18/2) shapes how regulated firms reward selling. Ordinary bank refer-a-friend offers remain live in the UK; consumer-credit promotions need review against the financial-promotion rules.
How do compliant financial referral programs stay compliant?
The compliant programs share a spine: fixed-dollar rewards on defined account events, published terms with eligibility and caps, product lines with special rules kept out of the reward logic, and an audit trail behind every payout. Fraud screening and payout records are what make the audit conversation short.
